Commonly Missed Mechanic's Lien Deadlines
Florida has strict deadlines which govern construction liens, commonly known as mechanic's liens. If you intend to file a mechanic's lien to help ensure you receive payment, here are some dates you should be aware of:
- you have only ninety (90) days from substantial completion of the work to file your mechanic's lien. You cannot rely on punch work to extend this deadline.
- You have forty-five (45) days from the day you first start the work or deliver materials to the job to file your Notice to Owner if you are not in direct contract with the owner.
- The mechanic's lien is valid for one (1) year from the date of recording. If a lawsuit is not filed to foreclose the Claim of Lien within the one (1) year, the mechanic's lien is void.
Construction Defects and Undisclosed "Latent" Defects

Latent defects are generally related to problems that are not readily apparent during the buying process — like a defective foundation. If the seller is aware of these defects then the seller is generally under an obligation to disclose them. Failing to do so opens the possibility for a civil construction lawsuit.
